"The Heights" is the ninth episode in the first season of the Fox drama series The O.C.. The episode aired on the fifth November, in 2003.
Synopsis[]
Ryan doesn't feel like he belongs at Harbor and Luke doesn't help his situation. Summer keeps her friendship with Seth private, but is jealous of his relationship with Anna. Sandy accepts a case against Caleb at his new job, that will test his relationship with Kirsten.
Plot[]
The boys are having breakfast getting ready for their first day of school. Seth tells Kirsten he can convey anything in a look and she says how "adorable" he looks. Sandy cuts his surfing time short since he wanted to see the boys go off for their first day. Ryan looks a little edgy about it when Seth asks how he can convey everything he is feeling with a look. Kirsten asks Ryan if he is nervous and he retaliates. Summer tells Marissa not to be nervous about her own first day as she is afraid to go after what happened in Mexico with her overdose and her ex-boyfriend cheating on her in The Escape. Jimmy is trying to cook them french toast for breakfast but he ends up burning it and Marissa thinks all of the social humiliation and scandal is a pretty good reason to skip school today. Kirsten tells the boys how this year will be different for them since Ryan and Seth have each other.
Summer defends Marissa when some girls gossip about the trip to Tijuana. Everyone is arriving at school for the first day. A water polo player "bumps" into Seth and some girls make catty remarks about Marissa's OD. Summer calls them whores and to go work another corner.
Marissa says she should just go home but Summer says that would be just as bad when they run into Ryan and Seth. Seth and Summer walk together while Ryan is relieved to see Marissa, a friendly face, Ryan asks her to hang out after school but she is in charge of the back to school carnival. She says she has been looking for an excuse to get out of it and Ryan says she has one now. Summer and Marissa are heading to class when Luke approaches them. Marissa walks away from him and Summer tells him to stay away. Luke says that won't be able to work since they all go to the same school. Summer says he should have thought of that before he cheated on Marissa and calls him an ass.
In the meantime Sandy and Kirsten share a brief moment together before their busy lives interrupt.
Back at the Cohens, Sandy is getting ready for work. Kirsten comments on Sandy's new look and smell and soon they're bickering about his "attractive" co-worker again with some kissing. Sandy says how much he loves Kirsten and how she is far more attractive than anyone.
Summer and Seth are walking to class when they run into Anna. Seth hugs Anna and Summer gets jealous and leaves. Anna thought that Seth had gotten over Summer. Seth says he can't not like Summer. She tries to give him tips on the ways of women telling him that girls like to be chased by guys they aren't interested in. Seth asks Anna to help teach him the ways. Rachel tells Sandy about a new case. A developer has purchased the Balboa Heights land directly above the preserved Balboa Wetlands, and they want to start digging. This could be a career making case for a tree hugging attorney so Rachel wants Sandy's help. Of course, she may also want his help because the plaintiff in said case is none other than Kirsten's dad, Caleb's firm. Sandy says it is a conflict of interest and thinks it wouldn't even be ethical. Rachel says that the firm thinks Sandy is the perfect advocate and Sandy responds saying his wife would have a different opinion.
At Harbor, Marissa walks into class and sees Holly from across the room, spreading more gossip about her overdose. In Ryan's class, he walks in to find Luke. Marissa is having a conversation with the dean, Dr. Kim, about possibly giving up social chair. Dr. Kim says that Marissa is looked up to. Marissa doesn't think she is anymore and Dr. Kim says that with her life changes aside, people are always going to talk and she should give them something good to talk about. Ryan is reading books he should have read over the summer, had he known when Seth and Anna join him. Marissa meets up with Ryan and she tells him she has to help with the school carnival. Marissa tells Ryan that she thinks getting involved with school again would be good for her. Ryan says he understands and Marissa asks to reschedule. Marissa suggest the carnival and how she will save him a seat on the ferris wheel. Ryan says no to ferris wheels because he doesn't do heights but they will figure something out. Marissa starts to feel bad and asks if he will be okay, Ryan says he has a lot of reading to catch up on. She leaves and Ryan looks around at everyone that knows each other and seems a little lonely.
The next morning, Kirsten tells Sandy how her dad is requesting breakfast and she says he sounds like he is in a crisis. Kirsten asks what Sandy is currently working on and Sandy doesn't exactly tell her. Kirsten asks to have lunch but he pushes it a few days out. In the kitchen, Ryan is still reading and seems to be moping about school. Ryan says that everyone has something and he doesn't. Sandy says that Ryan has Seth to which he says that Seth has his women and Sandy can't believe that is plural. Sandy says he needs an activity or sport to do. Seth walks in and suggests that Ryan could finally bring the athleticism forth in the family. Seth says he always wanted to play soccer and Ryan says he used to play soccer. They all decided on Ryan and soccer.
Marissa and Jimmy are getting ready for another school and non-work day when he asks if she has talked to her mom. Marissa says ho and apologizes about everything. Marissa wishes that her dad told her and he says that things will be different now. The doorbell rings and Jimmy thinks it is the phone company. He opens the door to find Luke. Luke is trying to be nice and charming and asks to talk to Marissa. Jimmy immediately tells him no and Luke continues to insist. Jimmy says how Marissa told him what happened and that she wouldn't want to talk to him. Luke asks what he can do and Jimmy says he could leave. Luke asks him to tell her, "Sorry." She thanks her dad for the treatment he gave Luke.
Ryan finds Marissa in the halls at school and asks how planning the carnival is going. She says Its as exciting as their debate over cotton candy vs funnel fries. Ryan says cotton candy to which Marissa says were her thoughts exactly. Marissa says she has time after school now and Ryan tells her that he has soccer tryouts. Ryan says the same thing she told him earlier about how getting involved in school might not be such a bad thing. Marissa smiles and tells him she could meet him after at the quad and Ryan agrees. Seth is about to sit next to Anna in science class when Summer walks in. Seth offers his seat to Summer which does not please Anna. Anna tells Seth to sit next to her on the same chair she is currently in. Seth follows what Anna is aiming at and catches on. Seth and Anna start talking about Anna's trip and they try to involve Summer. Summer becomes jealous and again, Anna shoots back with her own comment.
Kirsten drops into Sandy's office for a visit. She wants to know when he was going to mention he's on the case. Sandy apologizes and tells her he isn't even sure he is going to take the case. Kirsten says there isn't one and Sandy makes his case, very passionately. They argue about the kind of damage it could cause if the preserve isn't saved. Kirsten can tell that Sandy is going to take the case and says how unethical it is. Kirsten leaves to make sure her father doesn't find out any of it. At the soccer field, Ryan jogs out and tells the coach, he wants to try out for striker. The coach tells him that Luke is the team's current striker. Ryan and Luke are put to compete against each other once again. Marissa is wrapping up her meeting when Luke comes to see her. Luke says they need to talk and she says she doesn't want to hear what she has to say. Luke tries to apologize when Marissa tells him she doesn't care how he feels because he didn't care about her when he cheated. Marissa says how he lied and humiliated her and sits down. Luke sits by her when Ryan sees them. Luke says they should start over because he doesn't know what he would do without her. Luke goes on to tell her he loves her and starts crying. Luke reaches for Marissa's hand when Ryan leaves. Marissa tells him that if she hadn't caught him, she would still love him and ends it. Marissa leaves and sees one of the outside doors closing but no one is there.
The next morning, Kirsten confronts Sandy with the newspaper. The lawsuit is front page news and Kirsten was trying to keep it from her dad. Sandy says how it wasn't supposed to go to the press and Kirsten points out how it's his firm. Seth and Ryan are getting ready for the day and Seth asks him what he has been up to. Ryan wants to tell Seth and he tries to get it out of him. Ryan tells Seth about how he saw Marissa with Luke, making up he thinks, because Luke was crying. Seth encourages Ryan to ask Marissa about it and she would tell him the truth. At the same time, Summer is telling Marissa to not tell Ryan about her conversation with Luke under any circumstances. Marissa says she should just be honest and Summer tells her not to because they haven't gone out yet. Ryan approaches Marissa at her locker and she asks what happened the night before. Ryan tells her something came up and Ryan asks what she did, hoping Marissa will tell him the truth. Marissa says nothing because her meeting went long and Ryan, visibly disappointed, asks how it went. She lies again and Ryan is just upset at this point when Marissa says she will see him at soccer, he leaves.
In bio lab, Summer is sketchy about dissecting a frog and tells Seth he's her lab partner. Anna rolls up and says Seth has a lab partner. All part of Anna's master plan to make Summer jealous. Sandy approaches Rachel and asks if she brought him on just so he could take the case. Rachel says they didn't have the case when Sandy got hired. Rachel asks to get on with the case and Sandy wonders what it might lead to him loosing. Rachel then asks if their marriage can't survive, what kind of marriage is it?
Over on the soccer fields, Marissa drops by to watch Ryan at the bench where Luke is currently at. Luke and Marissa have an awkward conversation about the day prior. They laugh over the last time Luke had cried which was the end of the My Girl movie. Ryan sees them together and draws his own conclusions. Marissa waves to Ryan who completely ignores her. Ryan and Luke are competing for the ball and Luke has it but Ryan completely takes out Luke's legs from behind.
Dinner at the Cohens is a very silent one. Seth, completely oblivious as to what has been going on with Ryan, asks him how soccer was. Ryan doesn't answer and Seth moves onto Sandy, also completely oblivious to the case, asks him how his new job is. Again, Seth gets no answer. Seth then tries Kirsten who basically tells him to shut up with a look. Ryan is doing homework in the pool house when Marissa comes by. Marissa asks about what happened at soccer and Ryan is very vague about it. Marissa asks why he is lying to her which Ryan turns around and asks the same thing. Ryan tells her how he knows about Luke and her and thought she should have told him the truth. Marissa says how it was between her and Luke and that it has nothing to do with Ryan. Ryan agrees and he says how it just isn't going to happen for them. Marissa agrees and leaves.
In the morning, Sandy confronts Ryan about the phone call from the soccer coach. Coach thinks Ryan has talent and a terrible attitude. Sandy tells Ryan this school can do great things for him. Sandy notices he is angry since he runs into spoiled rich kids everyday at schools whose asses he'd like to kick. Sandy tells him that he has to figure it out because besides school, they are always one mistake away from someone taking Ryan from them. Ryan seems to wake up a bit and realize he needs to straighten up.
At school, Seth tells Ryan to bite the bullet and apologize. Ryan tries to apologize to Marissa but Summer grabs her and they head to class. That night, Sandy brings home flowers for Kirsten while she has a glass of wine in the hot tub. Kirsten is listening to Dont Give Up On Me by Solomon Burke and Sandy says how much he lives Burke. He tells Kirsten he is going to take the case and apologizes about who she married. Kirsten says she knows. Kirsten says how its going to be a long year since it's her husband vs her father. Kirsten tells him she couldn't be married to a man who isn't a man. Kirsten then says they will get through it since there is a reason they are together. They kiss and make up and Kirsten nearly drags him into the hot tub when both their phones ring, interrupting once again.
At the carnival, Seth and Anna continue bonding over skee ball. Ryan joins them both after he haas been searching for Marissa. Anna rolls a great shot and Seth goes off to exchange their tickets for prizes. Ryan starts to play and he asks Anna why she is helping Seth with Summer. Anna says why not and tells Ryan that Seth doesn't see her "that" way. Anna says that Seth just sees her as a friend and Ryan asks if she is okay with that. Anna doesn't answer and Ryan tells her tells her to take a shot with Seth. Ryan spots Marissa heading the Ferris wheel and takes off. Ryan runs into Luke and apologizes to him about soccer practice. Luke sees he is heading off to see Marissa and lets him go. Marissa is getting onto the ride and Ryan sets in place of Summer. Marissa asks what he is doing and Ryan says he wants to talk. The ferris wheel starts to move them up when Marissa says she thought Ryan was afraid of heights. He says he is but its important. He starts to tell her how he said somethings when the ferris wheel stops at the top. Anna paid off the worker to keep them up there for a few minutes so that they can make up.
Anna tells Seth that she needs to tell him something. She then grabs Seth and gives him a kiss, taking Ryan's advice. After, she sees Seth looking at Summer. He then asks Anna if this kiss is part of the plan. Anna says yes, sadly and Seth goes to talk to Summer. Before he does, Seth gives Anna the stuffed monkey he won with their tickets. Summer tells Seth she needs a ride buddy for the Tilt-a-Whirl and off they go. Anna watches and clutches the stuffed monkey Seth got her with the skee ball tickets. Fifty feet in the air, Marissa asks Ryan if he is okay as he continues to struggle. Marissa messes with him by swinging their spot up in the air. He then turns to her with his eyes closed saying that he doesn't talk a lot and he doesn't really trust people. Ryan tells Marissa that he does trust her. Ryan then says that he wants to make it work between them, "no matter what." Marissa tells him he needs something to take his mind off his fear and Ryan starts to figure out what. Marissa leans over and kisses Ryan as Paint the Silence by South plays in the background. Ryan and Marissa making out as the ferris wheel starts to move again and they reach the bottom. Ryan tells the worker to send them back up one more time. Marissa and Ryan laugh and continue to make out.
